Texas Foundation Repair Rules: What Pflugerville, TX Homeowners Should Know

Before a foundation job starts in Pflugerville, TX, it helps to know which rules come from the state and which come from the city or county. This page covers both for homes in Travis and Williamson Counties and the towns around Pflugerville, so you can ask clear questions before any piers go in.

Quick Summary of the Rules

Texas has no state license for foundation repair contractors. The Texas Residential Construction Commission was abolished, and its Act expired, on September 1, 2009. Nothing replaced it, so no company can show you a state license for this trade.

What does apply is a set of state consumer laws and local building rules. State law covers insurance deductibles, sales made at your home, defect disputes and deceptive practices. Cities set their own permit rules, and two nearby cities make contractors register. This is a summary of public law, not legal advice.

Vetting a Contractor Without a State License

With no state license to look up, the checking falls to you. Round Rock says every contractor and subcontractor who applies for a building permit there must be registered with the city. Hutto has contractors finish its registration process before they can file permit forms. Ask the specialist for these items in writing:

  • A certificate of liability insurance. Make sure it is current and names the company that will do the job.
  • The engineer answer. Ask if a licensed professional engineer will study the house or put a seal on the repair plan, and who hires that engineer.
  • Who pulls any permit. Get the answer into the contract. For a job in Round Rock or Hutto, confirm the company holds that city's registration.
  • A written scope. The number and type of piers, and where each one sits on a drawing of the house.
  • The warranty terms. Which parts it covers, how many years it lasts, and whether a buyer inherits it.
  • Local references. Names of a few recent jobs near Pflugerville that you can ask about.

When a Policy Pays for Foundation Damage

Water from a slab leak or poor drainage can soak the clay and let part of a house shift. Whether insurance helps is a question only your insurer can answer, so ask your own insurer what your policy covers.

If a claim does pay for work, Texas law draws firm lines. Business and Commerce Code § 27.02 makes it an offense for anyone selling goods or services paid from a property-insurance claim to waive, absorb, rebate or credit your deductible without the insurer's consent, or to advertise that offer. You pay your own deductible. A contract of $1,000 or more that is expected to be paid from a claim must show a deductible notice in bold type.

A second law, Insurance Code § 4102.163, says a contractor may not act or advertise as a public adjuster for a property where it does the work. Your claim stays between you and your insurer, or a public adjuster you hire yourself.

How to Back Out After Signing

Business and Commerce Code chapter 601 covers sales made during a personal visit at your home. When that contract tops $25 and you sign it at home, the law usually gives you until midnight of the third business day afterward to cancel. Some sales are exempt, so read the cancel notice in the contract and ask questions.

Pflugerville adds its own rule for door-to-door sellers in City code chapter 111. Each peddler or solicitor needs a City permit, applied for through the police department, and must carry it and show it when asked. Home visits from these sellers are off limits from 9 p.m. to 8 a.m., and at any door posting a "no solicitation" sign.

Two more laws matter if a finished job goes wrong. Under the Residential Construction Liability Act, Property Code chapter 27, an owner must mail written notice of a defect, return receipt requested, at least 60 days before suing. The contractor may ask to inspect within 35 days and may offer to fix or settle within 60 days. The Deceptive Trade Practices Act, § 17.46, bans false, misleading or deceptive business practices, including bait ads and fake price cuts. Complaints can go to the Texas Attorney General's Consumer Protection Division. This is a summary, not legal advice.

Engineer Sign-Off and Resale

In Texas, the state board that oversees engineers is the Texas Board of Professional Engineers and Land Surveyors (TBPELS). Its policy opinions cover methods for repairing home foundations and how slabs are evaluated, and the Board investigates engineers who seal pier plans without proper analysis. Round Rock's repair permit calls for an engineer of record. Manor's residential guidelines want an engineer's stamp on all foundations for new homes, so ask whether its repair permit needs one too. For a Pflugerville home, ask the City if your permit calls for an engineer's letter or plan.

A future buyer may ask what was done. Keep these papers together:

  • Permit and final inspection. Any permit number and the sign-off from the office that issued it.
  • Engineer's report or letter. The sealed plan, plus a final report if the engineer wrote one.
  • Floor readings. Dated elevation numbers from before and after the lift.
  • The pier map. A drawing that marks every pier's spot and type.
  • The warranty. The signed terms and any form needed to transfer them to a buyer.

Checking Permits With the City

The City of Pflugerville's building code, City code chapter 150, applies to all construction in the city and covers the erection, construction, enlargement, alteration and repair of buildings inside city limits. The City has adopted the 2021 International Residential Code and related 2021 codes, plus the 2020 electrical code. Each office below sets its own process.

  • City of Pflugerville. Find out from the specialist who will pull any City permit. Before work begins, confirm with the Building Inspections & Permits office in the Development Services Center, listed on the city's website. A lot in a mapped floodplain may also need a City floodplain permit under the Flood Damage Prevention chapter.
  • Round Rock, TX. City of Round Rock Building Inspection, 301 W. Bagdad Ave., Suite 100. Its online residential Foundation Repair permit needs an engineer-of-record letter, a sealed plan and, before the last inspection, a final engineer's report. Review runs about three to five business days, and a permit left unused for six months expires.
  • Hutto, TX. Permits and Inspections Division of Development Services, 500 W. Live Oak Street. Contractors register first, then apply online. Ask the division whether your repair needs a permit.
  • Manor, TX. City of Manor Development Services takes applications online, and its own permit report lists a "Residential Foundation Repair" permit type. Check the City of Manor's website for the permit office.
  • Unincorporated Travis County, including Wells Branch, TX. Travis County Transportation & Natural Resources, Development Services permit desk, 700 Lavaca St., Suite 540, Austin. A county development permit is required for all repairs on flood-damaged structures. For other repairs, check with the county before work starts, and know whether the lot is in a floodplain.
  • Unincorporated Williamson County. The county does not list a single-family building permit. Homes in a mapped floodplain should check with the County Engineer.
  • Elgin, TX. Inside Elgin city limits, check with the City of Elgin Building Division before foundation work. Outside city limits, ask the county.

Foundation Rules FAQ

Can a foundation company show me a Texas license?

No, because the state does not issue one. The commission that once oversaw home builders closed in 2009. Ask for an insurance certificate, a written scope and warranty, and whether an engineer will review the plan. In Round Rock and Hutto, you can also ask whether the company is registered with the city.

Will a company pay my insurance deductible for me?

It should not. Texas makes it an offense for a seller paid from a property claim to waive, absorb, rebate or credit the deductible without the insurer's consent, or to advertise that it will. Treat any such offer as a reason to slow down. Plan to pay the deductible yourself, and ask your own insurer what your policy covers.

Does a Pflugerville repair need an engineer's report?

We could not confirm a City rule either way. Check with the Building Inspections & Permits office on what your permit needs. Then find out from the specialist if an engineer will review the house or seal the plan. Round Rock is different: its repair permit asks for an engineer of record, a sealed plan and a final report.

A salesperson knocked on my door. What should I check?

Pflugerville requires each door-to-door seller to hold a City permit, and you may ask to see it. Knocking is not allowed from 9 p.m. until 8 a.m., or at homes with a "no solicitation" sign. A contract you sign at home can usually be canceled through midnight of the third business day.

Where do I send a complaint about a contractor?

For deceptive business practices, file with the Consumer Protection Division of the Texas Attorney General. For a defect in finished work, follow the written notice steps in the Residential Construction Liability Act, and think about talking with a lawyer. Permit questions go to the office that issued the permit.
